1. User Responsibility for Backed-Up Content

You are solely responsible for ensuring that the content you back up through our service does not violate copyright laws, intellectual property rights, or any other applicable regulations. ypbackup does not monitor or verify the content uploaded or backed up by users and is not responsible for any legal implications related to the materials stored using our platform.

Our service does not grant you any additional rights to the content you back up. If you back up videos, music, or other media from YouTube, SoundCloud, or any third-party services, you are responsible for ensuring compliance with their respective terms of service and copyright policies.

2. Compatibility with Third-Party Platforms

Our service provides tools for users to back up their media content from platforms such as YouTube, SoundCloud, Vimeo, and other supported services. However, these third-party platforms may change their API policies, restrict access, or block our service at any time. We do not guarantee uninterrupted compatibility with any third-party service.

Users must understand that backing up content from third-party platforms may be subject to restrictions imposed by those platforms, and we are not responsible for any limitations, suspensions, or bans that may occur as a result.

3. Availability of Service

While we strive to provide a stable and reliable backup service, we do not guarantee uninterrupted access or error-free operation. Service disruptions may occur due to maintenance, system failures, or unforeseen circumstances. We are not liable for any data loss, service unavailability, or interruptions. Users are advised to download their backups promptly to prevent potential loss of data.

4. Payments and Refund Policy

We reserve the right to modify our pricing at any time without prior notice. Subscription fees are non-refundable except under the following conditions:

• Users may request a refund within 7 days of their first purchase if they are not satisfied with our service. This refund is available only once per user.
• No refunds will be issued for violations of these Terms of Service, fraudulent activity, or misuse of our platform.
• If a user fails to comply with the service policies or engages in prohibited activities, their account may be terminated without eligibility for a refund.

5. Account Termination

Users may terminate their account at any time. However, once an account is terminated, no refunds will be provided for any remaining subscription period. ypbackup reserves the right to suspend or terminate any account that violates these terms, engages in fraudulent activity, or misuses the platform.

Upon termination, all stored backups will be permanently deleted. Some information, such as payment records, may be retained for compliance with financial and legal obligations.

6. Prohibited Activities

Users agree not to misuse our service or engage in activities that disrupt, damage, or compromise the platform.

• Attempting to breach, probe, or compromise the security or integrity of our platform.
• Uploading or distributing malicious software, viruses, or other harmful programs.
• Using the service to engage in fraudulent, deceptive, or unlawful activities.
• Abusing the service in a way that may overload, disrupt, or interfere with normal operation.
• Using temporary or disposable email addresses for account registration. Such accounts may be restricted or permanently banned.

Violations of these rules may result in suspension or permanent termination of the account and restriction of access to our services.

7. Illegal Content & Child Safety

Our platform strictly prohibits the use of our services to access, download, store, or distribute illegal or harmful content.

• Any material involving child sexual abuse, exploitation, or endangerment of minors.
• Pornographic, obscene, or sexually explicit material involving minors.
• Content that promotes extreme violence, abuse, or other harmful acts.

We maintain a strict zero-tolerance policy toward any content that exploits or harms children. Accounts involved in such activities will be immediately suspended or permanently terminated.

We reserve the right to remove prohibited content, block access to our services, and report such activities to appropriate law enforcement authorities where required by applicable law.

We take reasonable measures to protect user data. However, no online service is completely secure. Users acknowledge that they use the service at their own risk and should take appropriate precautions, such as maintaining their own backups of critical data.

9. Fair Usage Policy

To maintain service stability and fairness for all users, we apply a Fair Usage Policy to resource-intensive activities, particularly repeated backup operations and excessive or repetitive download requests.

Activities that significantly deviate from normal usage patterns — such as repeatedly backing up and deleting the same content, or downloading the same files an unreasonable number of times — may trigger temporary speed limitations or other protective measures.

We reserve the right to adjust the criteria for these measures at any time. In cases of clear and sustained abuse, we may temporarily restrict access, throttle speeds, or, after prior notice where feasible, apply additional charges. Accounts found deliberately circumventing these protections may be reviewed, restricted, or terminated without refund.

10. Changes to the Terms

We may update these Terms of Service at any time without prior notice. Users are responsible for reviewing this page periodically to stay informed about any changes.

11. Limitation of Liability

ypbackup shall not be liable for any direct, indirect, incidental, consequential, or punitive damages resulting from the use of, or inability to use, our service.

12. Governing Law

These Terms of Service are governed by and interpreted in accordance with the laws of US. Any disputes shall be resolved through arbitration or legal proceedings in US.

13. Service Suspension or Modification

We reserve the right to suspend, modify, or discontinue any part of our service at any time. This includes changes to storage limits, pricing structures, or supported platforms. Users will be notified of major changes, but we are not liable for any inconvenience caused.
